Applicability to Entrepreneurs and Definitions of Terms
(1) The following General Terms and Conditions apply to all deliveries and the provision of services between us and a consumer in their version valid at the time of the order.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity (§ 13 BGB).
Conclusion of a contract, storage of the contract text
(1) The following provisions regarding the conclusion of the contract apply to orders and services.

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but merely an invitation to the consumer to place an order. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.
(4) The following regulations apply upon receipt of an order in our online shop:
The consumer makes a binding offer to contract by successfully completing the ordering procedure provided in our online shop.
The order is placed in the following steps:
- Selection of the desired goods
- Add selection to cart
- Review of the information in the shopping cart
- Clicking the "Proceed to Checkout" button
- Entry of buyer information (address, payment details, delivery address, etc.)
- Repeated verification or correction of the respective entered data
- Binding submission of the order by clicking the "Buy Now" button
Before submitting the order bindingly, the consumer can return to the webpage where the customer's details are recorded by clicking the "Back" button in their internet browser to review their information and correct any input errors, or they can cancel the order process by closing the internet browser.
We confirm receipt of the order immediately after purchase by an automatically generated email ("order confirmation").
(5) Storage of the contract text for orders placed through our online shop: We store the contract text and send you the order details and our Terms and Conditions by email. You can also view the Terms and Conditions at any time at https://www.evertree.de/allgemeine-geschaeftsbedingungen.
Prices, Shipping Costs, Payment, Due Date
(1) The prices stated include the statutory value-added tax and any applicable shipping costs.
(2) The consumer has the option to pay for the goods via PayPal or Amazon Pay.
Delivery
(1) Unless we have explicitly stated otherwise in the product description, all items we offer are ready for immediate dispatch.
The delivery will be made no later than within 5 business days. In the case of payment in advance, the delivery period begins on the day after the payment order is given to the bank responsible for the transfer, and for all other payment methods, it begins on the day after the conclusion of the contract.
If the deadline falls on a Saturday, Sunday, or public holiday at the place of delivery, the deadline shall end on the next working day.
(2) The risk of accidental loss and accidental deterioration of the sold item also passes to the buyer only upon delivery of the item to the buyer in the case of a shipment purchase.
Retention of title
We reserve ownership of the goods and the commencement of the service until full payment of the purchase price has been received.
Warranty
The statutory warranty provisions apply.
Contract language
The only language available for the contract is German.
Right of Withdrawal Information
Customer's Right of Withdrawal as a Consumer:
Consumers have a right of withdrawal under the following conditions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities:
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

by means of a clear statement (e.g., a letter sent by post, fax, or email) informing us of your decision to withdraw from this contract. You may use the attached model withdrawal form for this purpose, but it is not obligatory.
Consequences of Withdrawal
If you revoke this contract, we will refund you all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without delay and no later than fourteen days from the day on which we receive the notification of your revocation of this contract.
For this refund, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise with you; in no case will any fees be charged to you for this refund.
We may refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us without delay and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. We bear the costs of returning the goods.
